These Terms of Service ("Terms") govern your access to and use of the website mataana.com (the "Site") and all associated forms and services operated by Mataana Limited ("Mataana," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

The Site and its content are intended for general informational purposes and to facilitate applications and enquiries through Mataana's programmes. You may not use the Site for any unlawful or unauthorised purpose. You agree to comply with all laws, rules, and regulations applicable to your use of the Site.

You must be at least 18 years of age and have the legal capacity to enter into these Terms in order to submit any form through the Site. By submitting a form, you confirm that you meet these requirements.

2. Forms and Submissions

The Site currently offers the following forms through which you may submit personal information to Mataana:

• Fractional Leader Application (/apply/fractional-leader): for senior executives seeking to join the Mataana fractional leadership network.
• Startup Funding Application (/apply/startup-funding): for founders seeking investment or support from Mataana Ventures.
• Co-Investor Application (/ventures/co-investors): for investors seeking to co-invest alongside Mataana.
• Hire a Fractional Leader (/hire/fractional-leader): for businesses seeking to engage a fractional executive through Mataana.
• General Contact Enquiry (/contact): for general, partnership, press, investor relations, and other enquiries.

By submitting any form through the Site, you represent and warrant that all information you provide is accurate, complete, and not misleading, and that you have the right to submit any documents or materials you upload.

Submission of any form does not constitute an offer of investment, employment, engagement, co-investment, or any other commercial arrangement. Mataana reserves the right to accept or decline any application or enquiry at its sole discretion and without providing reasons.

3. Consent Requirement

All application forms on the Site include a mandatory consent checkbox that must be ticked before submission. By ticking this checkbox, you confirm that you have read and understood our Privacy Policy and these Terms, and that you consent to Mataana processing your personal data for the purpose of evaluating your application or enquiry.

You may withdraw your consent at any time by contacting us at [email protected]. Withdrawal of consent does not affect the lawfulness of any processing carried out prior to withdrawal.

4. Uploaded Documents and Materials

Certain forms on the Site allow you to voluntarily upload supporting documents, including curriculum vitae (PDF or Word, up to 3 MB) for Fractional Leader applications, pitch decks (PDF or PowerPoint, up to 3 MB) for Startup Funding applications, and supporting documents (PDF or Word, up to 3 MB) for Co-Investor applications.

By uploading any document through the Site, you grant Mataana a limited, non-exclusive, royalty-free licence to store, access, and review that document solely for the purpose of evaluating your application. This licence terminates automatically when your application data is deleted in accordance with our data retention policy.

You retain all ownership rights in any materials you upload. Mataana will not share uploaded documents with third parties except where required by law or with your explicit consent.

You must not upload any material that is unlawful, defamatory, obscene, fraudulent, or that infringes any third-party intellectual property rights, confidentiality obligations, or other rights. Mataana reserves the right to delete any uploaded material that violates these Terms without notice.

5. Data Retention

Personal data and any uploaded documents submitted through our forms are retained for 28 days from the date of submission. At the end of that period, all records and associated files are automatically and permanently deleted from our systems. This policy applies to all five form types listed in Section 2.

6. Intellectual Property

The Site and its original content, features, and functionality are owned by Mataana Limited and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. 7. No Investment, Legal, or Financial Advice

Nothing on this Site constitutes investment advice, financial advice, legal advice, or any other form of professional advice. The information on this Site is provided for general informational purposes only. Any descriptions of Mataana's investment activities, portfolio companies, or programmes are for informational purposes and do not constitute an offer or solicitation to invest. Past performance of any investment or programme described on this Site does not guarantee future results. Mataana makes no representations or warranties regarding the likelihood of success of any application, investment, or engagement.

8. Disclaimer of Warranties

The Site and its materials are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Mataana disclaims all warranties, including without limitation implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of information. Mataana does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Mataana or its directors, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, goodwill, business opportunity, or other intangible losses, arising out of or in connection with:

This limitation applies even if Mataana has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.
